Discipline / Discharge

The collective agreement must provide fairness and due process for workers disciplined or discharged.  Here are some basic key elements:

  • no discipline or discharge without just cause;
  • prior notice in writing to employee and workplace representative of fair and impartial investigation and nature of the charge;
  • workplace representative must be present at hearing;
  • record cleared after specified period without incident;
  • right to see personal file;
  • continue “just cause” protection during strike/lock-out;
  • discipline and discharge during a strike/lockout will be arbitrated on the basis of just cause if not resolved in the return to work agreement.
